    1. Agreement to Terms

    By accessing or using Insaga ("the Service"), operated at insaga.net, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.

    2. Description of Service

    Insaga is an AI-powered animation video maker that generates visual content (images, videos, audio) from text input. The Service uses third-party AI models (including but not limited to Google Gemini, OpenAI) to generate content. Insaga is a custom interface built on these AI technologies and is not affiliated with, endorsed by, or sponsored by Google, OpenAI, or any other AI model provider.

    3. User Accounts

    You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use the Service.

    You agree to provide accurate information and to keep your account information up to date. You are responsible for all activity that occurs under your account.

    4. Subscriptions and Payments

    The Service offers free and paid subscription plans (Animator, Director, Studio). Paid plans are billed monthly or annually through our merchant of record, Creem.io, or via cryptocurrency through NowPayments.

    Subscription fees are charged at the beginning of each billing period. Prices are listed in USD and may be subject to applicable taxes.

    You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to your plan's features until the end of your current billing period. No partial refunds are issued for unused time within a billing period.

    5. Refund Policy

    We want you to be satisfied with our Service. Our refund policy is as follows:

    • First-time subscribers: If you are not satisfied with the Service, you may request a full refund within 7 days of your first payment by contacting us at [email protected].
    • Renewal payments: Refunds for renewal payments are not available, as the subscription can be cancelled before the renewal date.
    • Cryptocurrency payments: Due to the nature of cryptocurrency transactions, refunds for crypto payments are handled on a case-by-case basis.
    • Service issues: If the Service is unavailable for an extended period due to our fault, we will issue a pro-rated credit to your account.

    6. Cancellation

    You can cancel your subscription at any time through your account menu in the Service. Upon cancellation:

    • Your plan will remain active until the end of the current billing period
    • Your remaining credits and coins will be available until the billing period ends
    • After the billing period ends, your account will revert to the Free plan
    • Your generated content and projects will remain accessible

    7. User Content and Intellectual Property

    You retain ownership of the text content you submit to the Service. For AI-generated content (images, videos, audio), you are granted a non-exclusive, worldwide license to use, modify, and distribute the generated content for any lawful purpose, including commercial use.

    You are solely responsible for ensuring that your input text does not infringe on any third-party intellectual property rights. You may not use the Service to generate content that imitates specific copyrighted characters, brands, or artistic works without authorization.

    8. Acceptable Use Policy

    Prohibition of NSFW / Adult Content

    Insaga strictly prohibits the generation, upload, or distribution of any NSFW (Not Safe For Work), adult, sexually explicit, pornographic, or obscene content through the Service. This includes, but is not limited to: nudity, sexual acts, sexually suggestive imagery, fetish content, and any material that would be considered adult-only. This prohibition applies to all content generated by the AI, uploaded by users, or shared through any feature of the Service. Every prompt destined for an image or video model is screened by an automated content-moderation service before generation; rejected prompts never reach a model and are not charged. Any attempt to bypass these safeguards is a violation of these Terms.

    You additionally agree NOT to use the Service to:

    • Create deepfakes: Realistic depictions of real people without their consent
    • Produce harmful content: Content that promotes violence, terrorism, self-harm, or hatred against individuals or groups
    • Generate illegal content: Child sexual abuse material (CSAM), content that violates any applicable laws
    • Infringe on rights: Content that violates copyrights, trademarks, or other intellectual property rights
    • Spread misinformation: Deliberately misleading content designed to deceive
    • Abuse the Service: Automated scraping, denial-of-service attacks, or attempts to circumvent rate limits or security measures

    Violation of this Acceptable Use Policy — including any attempt to generate NSFW or adult content — may result in immediate account suspension or termination without refund. We reserve the right to remove any content that violates these terms and to report illegal content to the appropriate authorities.

    9. AI-Generated Content Disclaimer

    Insaga uses AI models to generate content. AI-generated content may not always be accurate, appropriate, or free of bias. We implement content moderation measures, but no system is perfect. You are responsible for reviewing and approving all generated content before publishing or distributing it.

    Insaga is powered by AI technology. We are not affiliated with, endorsed by, or sponsored by Google, OpenAI, or any other AI model provider. Our product is a custom interface built on publicly available AI APIs.

    10. Service Availability

    We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service downtime.

    11. Limitation of Liability

    To the maximum extent permitted by law, Insaga shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

    12. Governing Law

    These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
